Law Enforcement Requests 

Backblaze, Inc. (“Backblaze”, “we”, “our”) respects the privacy and security of our account holders’ data. We disclose account holder information or stored data (collectively, “Information”) solely in accordance with our Terms of Service, Privacy Notice, and applicable laws and regulations.

This page provides an overview for authorized U.S. and international law enforcement agencies seeking Information from Backblaze.

Required Legal Process - Intake Form

As a streamlined alternative to traditional methods, Backblaze accepts service of valid legal process pursuant to applicable law from governmental and law enforcement agencies through this Law Enforcement Request (LER) intake form. You must attach complete legal process to your submission, so that Backblaze can confirm that the documents satisfy the laws applicable to the request. 

When governmental or law enforcement agencies submit complete documentation through the intake form, there is no need to also mail paper documents. NOTE: Civil subpoenas or civil litigation discovery may NOT be served through the intake form. Legal process from private parties and/or involving civil litigation must still be properly served upon Backblaze’s registered agent.

By simplifying the process for valid governmental/law enforcement agencies, Backblaze does not waive its right to object to incomplete requests, requests which do not comply with applicable laws, or unduly burdensome requests for which Backblaze might seek to quash, or for judicial intervention regarding the scope of the requests, etc. 

Backblaze will only produce Information in response to a valid and legally-binding U.S. legal process.

  • All subpoenas, court orders, or search warrants must be issued or signed by a U.S. judge or court of competent jurisdiction, even if the requesting agency is located outside the United States.
  • Requests must be properly served on Backblaze in accordance with applicable U.S. law.
  • We do not voluntarily disclose Information without valid legal process, except as permitted under applicable law (e.g., Emergency Disclosure Requests).

International Requests

Backblaze is a U.S.-based company. Requests from non-U.S. law enforcement agencies must be submitted through appropriate U.S. legal channels (e.g., the MLAT process) or otherwise comply with U.S. law.

Types of Requests Accepted

Backblaze accepts the following types of legally binding requests:

  • Subpoenas
  • Court Orders
  • Search Warrants
  • Preservation Requests (see below)
  • Emergency Disclosure Requests (see below)

Other Information

Preservation Requests

Upon receipt of a valid preservation request under applicable U.S. law, Backblaze will take steps to preserve specified Information for a limited period of time pending receipt of formal legal process.

  • Preservation requests must include a Backblaze account ID or email address for Backblaze to identify the  specific account(s) to be preserved.
  • Preservation requests are valid for 90 days, after which a renewal request may be required.
  • Backblaze will not disclose preserved content unless and until we receive a valid compulsory legal process.

Emergency Disclosure Requests

If you believe there is an emergency involving imminent risk of death or serious physical harm that requires immediate disclosure of Information, you may submit a request through email via ler@backblaze.com with the subject line “Emergency Disclosure Request” and the following data points:

Emergency Disclosure Requests must include:

  • A description of the emergency circumstances
  • The specific Information requested
  • An explanation of how the requested Information relates to the emergency
  • Contact information for a law enforcement officer authorized to make the request

Backblaze will evaluate Emergency Disclosure Requests in accordance with applicable law. Submission of an Emergency Disclosure Request does not guarantee disclosure.

Notification to Account Holders

Backblaze’s policy is to notify account holders of legal requests for their Information unless:

  • The request is accompanied by a valid Non-Disclosure Order (NDO) or gag order issued by a court of competent jurisdiction; or
  • We are otherwise prohibited by law from providing notice.

If a valid NDO or gag order is not included, Backblaze may notify the account holder.

Processing and Response Time

Backblaze reviews and processes law enforcement requests in a timely manner. Response times may vary depending on the scope, complexity, and legal sufficiency of the request.

We do not commit to specific service level agreements (SLAs) for law enforcement requests.

Responses will be provided via electronic delivery to the verified official email address of the requesting agency.

Right to Object

Backblaze reserves the right to object to or seek clarification regarding any request that is overly broad, legally insufficient, or otherwise inconsistent with applicable law.
